I agree with you. I knew a guy that went to prison because a drunk guy tried to pick a fight with him. He was smacked in the face 3 times by the drunk and was trying to walk away before he retaliated. He punched the guy 1 time breaking the drunks cheek bone, but the drunk fell back on the sidewalk, his skull cracked and he died instantly. 6 1/2 years.
