I can guarantee that in some cases a skateboard may do more damage than a bat.

I was a skater since I was 13 till I was 19. Never once did I ever think of hitting somebody in the head (while their back was turned no less) for, as you say, "talking shit". We just played the game. We talked shit right back, and then usually played a game of cat and mouse running from security. Never once did assault with a deadly weapon ever cross my mind.

There were a few times when I thought I was going to have to do that in self defense because people would threaten us with bodily harm. I never understood why people hated us so much. Now that I'm older and I see the disregard for personal property and the lack of respect that a few skaters have towards society, I completely understand.

Working as a security guard myself I was nearly always nice about it. But whenever I had to deal with punkass teenagers or skaters I couldn't help being pissed off. Actually, no, not automatically it isn't. Usually a case like this will be prosecuted as "Assault with a deadly weapon". In order for it to be attempted murder, you have to prove either intent (whether the intent be willful or reckless). Now, what constitutes intent? Basically, you wanted to kill the person. With reckless intent, it is more complicated but basically states that you willfully took an action that could kill somebody, but it wasn't guaranteed that anyone would be 'in the line of fire' so to speak.

From the look of this video, I don't see either intent or reckless intent. I do see that the skater probably meant to hurt the guy, but not kill him. I think he will get slapped with first degree assault and assault with a deadly weapon.

First off, for those that say the guard was doing his job, he wasn't.

"Be a total dick" is not in any job description for any security guard. Even when a guard is to use the limited amount of force they are allowed to, they are to be polite about it. If it gets out of the hands of the guard (such as the person in question being a total tard or refusing to leave, etc) then they call the cops. Security is there to maintain a presence of order, and in limited circumstances and with limited force, enforce order.

The fact that this guard felt he needed to be a prick comes from either power tripping or bad organization (or both).

On another note, it's good that skaters are starting to fight back. Most guards do their job and are nice about it, but I have seen many videos of guards outright assaulting skaters or stealing their skateboards (security does not have the right to confiscate private property). However, the skater in this video went a bit too far. He could have killed the guy.

No, that is not a power trip. However, this guy did step over the line. Mild force involves putting your hand on their shoulder and walking them out, or interposing yourself between them and where they wish to go. In extreme circumstances, they may cuff a person and then call the cops. BY LAW security cannot do any more than that. Security guards are not police. Hell, if this was a cop, how many people would be crying 'abuse of power' right now?

Actually, not true. By law, a security guard's role is to 'observe and record' and if necessary, maintain the peace through non-violent measures. If it comes to multiple or aggregious infractions, then the police are called.

Actually, it is more common than you think. There's a lot of minimum wage fucktards out there who think they are cops because they wear a badge. I know, I've worked with them.

Also I have seen horrible abuses of power by guards. Chances are that these kids have encountered guards like that before and were a bit fed up.

Well I certainly would agree with that. The guard definitely did deserve a good smacking, but hitting him from behind with a skateboard was just low. The guard was being a jerk, needed a put down but obviously this skater didn't know where the limit was.
